In reply to N.Z A.A. 531 of 16/11/15 - 
In as much as the interest of a number off officers in different
Divisions are involved, it is respectfully requested that the
question raised by me, and my several letters thereon may be
referred, for the favour of a ruling, to higher authority. -
In viewing the letter under reply, may I be permitted to
add that even the actions of the Federal Executive Council
were erroneous, it is submitted that Army order 35 of 1915
governs this case and, being of more recruit data, overrides King's
Regulations S 224 (iii), - the data assigned respectively to the several
officers in the London Gazette of July 9/15 being the "date of appointment
or promotion" referred to in such Army Order, and being, in
fact, the data on which each of the officers referred to was first "appointed"
to the A.I.F. by the Commonwealth Government.
But I beg to point out that an Executive Minute by the Governor
General-in Council, of the Commonwealth is conclusive, & must be
taken to express the deliberate intention of the Commonwealth Government
to grant promotions in the A.I.F. in the order of precedence
stated. - Moreover, this action has been confirmed by
the promulgation of their promotions in A.I.F. orders, List No
10, of 14/11/15, so that they are actually in full force within
the Army Corps. -
